1. Service Description
HRHolly provides an integrated HR Platform designed to manage organizational data, employee records, document storage, and strategic planning workflows (the "Service"). The Service is provided as a cloud-based solution to assist organizations in streamlining their HR operations.
2. User Roles & Access Control
HRHolly provides a flexible, role-based access control system. All user roles, permissions, and individual access levels are defined, assigned, and managed exclusively by the Customer. We do not have access to your specific solution configurations, internal role structures, or individual user data patterns.
The Customer is solely responsible for configuring roles in compliance with their own internal security policies, data protection standards, and legal requirements. HRHolly provides the framework, but the Customer maintains complete ownership and control over who has access to which information within their tenant.
3. Data Storage & Residency
By using HRHolly, you consent to the storage and processing of data. Our infrastructure is distributed as follows:
- Documents: Contracts, IDs, and uploaded files are securely stored in Sweden.
- Application Data: Database records and user profiles are stored in Holland (The Netherlands).
4. Data Processing Agreement (DPA)
The relationship between the Customer as Data Controller and HRHolly as Data Processor is governed by our Data Processing Agreement (DPA), which is incorporated into these Terms by reference. The DPA sets out the parties' obligations regarding the processing of personal data in accordance with applicable data protection laws.
5. Customer Responsibilities
The Customer is responsible for:
- Ensuring all use of the Service is lawful and complies with local labor laws.
- Providing necessary notices to employees regarding data processing within HRHolly.
- Maintaining the confidentiality of account credentials and overseeing all activity under their organization's account.
6. Availability & Support
While we strive for 24/7 availability, the Service is provided on a "best effort" basis. Scheduled maintenance will be communicated in advance whenever possible. Technical support is available based on your selected package tier.
7. HR-Specific Disclaimer
IMPORTANT: HRHolly is a software tool for organization and management. We do not provide legal, tax, or employment advice. All templates and frameworks are provided for convenience and should be reviewed by your legal counsel to ensure compliance with local regulations.
8. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Data) are and will remain the exclusive property of HRHolly and its licensors. User Data remains the property of the Customer.
9. Limitation of Liability
To the maximum extent permitted by law, HRHolly shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses.
10. Termination & Suspension
We reserve the right to suspend or terminate access to the Service for any breach of these terms, non-payment of fees, or activities that may harm the platform or other users.
11. Governing Law & Jurisdiction
These terms are governed by the laws of Denmark. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Denmark.
